By making a bequest to the A Rocha Foundation, you can ensure the continuity of essential conservation projects, such as the preservation of the Courmettes or the development of the Ambassadors network. There are several ways of making a bequest, with no minimum amount required, and you can change it at any time.

How does it work? A bequest can relate to a specific asset or a portion of your estate. It can also be intended to support specific projects such as the protection of biodiversity. It’s simple: all you have to do is draw up a will.

What is a bequest?

A bequest is a transfer of assets by will. There are several types of bequest, each with its own characteristics and conditions. It reflects your values, your convictions and your commitments.be

In general, it is possible to name a charitable organisation, such as the A Rocha Foundation, as a universal legatee in a will. This means that the organisation will receive all or part of the estate after debts and expenses have been paid.

However, it is also possible to provide for a specific bequest to a loved one while leaving the foundation to receive the entire inheritance. To do this, it is necessary to specify in the will that the A Rocha Foundation will receive the main inheritance, and that the specific bequest to a relative (for example, a specific amount or an item of property) will be taken from the Foundation’s inheritance, without incurring any costs or duties for that relative. This could reduce inheritance tax or enable direct support for the Foundation while taking care of loved ones.

To make sure that everything is in accordance with local laws, it is strongly recommended that you consult a notary or a lawyer specialising in inheritance law.

The different types of bequest

There are three types of bequest:

  1. a specific bequest, in which you leave one or more specific items of property (a painting, a share portfolio, a building, etc.);
  2. a universal bequest, in which you bequeath only part of your assets (half, for example) or a category of assets (property, furniture, etc.);
  3. a universal bequest, in which you give all your assets to one or more people or to a foundation such as the A Rocha Foundation. There is no minimum amount for a bequest.

How and when should a bequest be made?

The wish to leave a legacy is expressed in a will.

There are two main types of will: an authentic will, drawn up and recorded by a notary in the presence of two witnesses or another notary, and a holograph will, written, dated and signed by the testator.

Making a will does not bind you during your lifetime. You can continue to freely dispose of all your assets without restriction until the end of your life. You can change or revoke your will at any time. Your estate and your wishes may change over the course of your life, so a new will can be drawn up as soon as you consider it useful. You are under no obligation to inform the A Rocha Foundation that a will has been drawn up in its favour.

Making a bequest to the A Rocha Foundation means protecting nature and raising awareness in the Christian world.

A concrete example

Do you have no spouse or children, and would you like to support the A Rocha Foundation without disinheriting your loved ones? Then designate the A Rocha Foundation as your universal legatee in your will by asking the Foundation to pay a specific bequest to your loved one, net of fees and charges.

Bequest of €100,000 only to your close relative with no family ties: Universal bequest of €100,000 to the A Rocha Foundation with a special bequest to your family member with no family ties:
Inheritance tax (tax paid to the State): 60% x €100,000 = €60,000 Amount of tax (paid by the Foundation): 24% x €100,000 = €24,000
Net portion bequeathed to your loved one : 40 000 €. Net portion bequeathed to your relative : 40 000 €
Net amount received by the A Rocha Foundation: € 0 Net amount received by the A Rocha Foundation : 36 000 €

The amount of your bequest will be allocated according to your expressed wishes. If the allocation of the bequest is not specified, the A Rocha Foundation will choose an allocation based on the projects most in need of funding.
